Introduction

Because Flitsmeister attaches great importance to respecting your privacy, we treat your personal data with all due care and we protect it very carefully. Flitsmeister abides by European and Dutch privacy legislation. This privacy statement explains how we handle your personal data.

Summary

Some of your personal data, including your contact and location details, will be processed when you use our services, such as the Flitsmeister app, Truckmeister app, Fleet or Trip History. We use this data in order to be able to provide our services. We ask you for your consent to use this data where necessary. If you have an account, you can purchase more services. There is a possibility that, due to the nature of such services, they require more personal data to be processed. If you purchase products from us, we will only use the order details to fulfil the order (including delivery), for support and guarantees, and for statutory obligations.

We do all we can to ensure your privacy. For example, we will never disclose your data to third parties unless you give your consent or we are forced to by a statutory requirement. We also make sure that your data is properly protected. Furthermore, we have taken measures to handle any location details extremely carefully. 

In the table below you can see at a glance in which way the services of Flitsmeister differ when it comes to the processing of personal data.

Who is Flitsmeister?

Flitsmeister is a trade name of Flitsmeister B.V. Our registered office is at Landjuweel 24, Veenendaal, the Netherlands, and we are entered in the trade register of the Chamber of Commerce under number 55408567.  

The Flitsmeister and Truckmeister app

Flitsmeister and Truckmeister are the most comprehensive traffic information apps for consumers and truck drivers. These apps are available for iPhone and the Android platform. The apps are made available free of charge. You can also subscribe for a account; the apps then offer more options. When we refer to the “app” below, we mean the Flitsmeister and Truckmeister app. In addition, there are the additional services called "Trip History" and "Fleet platform". We will explain these later in the statement.

What data does Flitsmeister process and for what purpose?

Flitsmeister processes the following data as a matter of course. 

On the website: 

  • Technical data. This concerns data such as one or more unique numbers that refer to the device you are using.

  • Cookies. We tell you more about the use of cookies in our cookie statement.

Webshop: 

  • Contact details: e-mail address, address and place of residence,

  • Payment details: Information about invoices and payments including the payment history.

The reason we ask for this information is very practical: after all, we will have to deliver the products. Your address details are shared with a delivery service so that they can carry out the delivery. Your data will then be included in our administration.

For all app users:

  • Technical information about your phone. These details include one or more unique numbers that connect to your phone. 


Subject to your giving the relevant consent in the app, we also process the following data for all users, regardless of whether they have an account: 

  • Location details. These are details about your exact location, direction, speed and the time when these details were measured. We need this data for various purposes, including processing reports about speed cameras and generating traffic information on an anonymous basis. You can read more about this further on in this privacy statement. 

And on top of this, the following data is processed for users with an account:

  • Contact details: your email address and password, as well as all contact details that you have added to your account (such as your gender, age, photo);

  • If you log in through Apple, Google or Bip&Drive: Apple, Google or Bip&Drive communicates certain details to us. We do not store all these details; we only store first name, surname, age bracket and gender. In the case of Bip&Drive, we also store whether the payment obligation for the subscription has been fulfilled;

  • Payment details: details about invoices and payments including payment history. 

  • Usage data: details about your past trips (subject to your consent, see below), details about your use of the additional services we offer, and settings and preferences checked in the app.  

  • Identity data: name, date of birth and place of birth when using the Fleet Platform (subject to consent, see below).

What are the purposes of processing this data?

In the previous paragraphs, we have explained which of your data we process (depending on the service you use).

Flitsmeister uses this data for the following purposes (for a summary see the table above). For each purpose, we state to which service it applies. The words "Fleet" and "History" here refer to the services "Fleet platform" and "Trip History", which we will explain later in the statement.

What is the legal basis for the processing of personal data?

The processing of your personal data is based on the following legal grounds:

  1. consent given by you (e.g. for the location data)

  2. for the performance of the contract with you

  3. legal obligations (e.g. tax legislation) and

  4. for the purpose of our legitimate interests (e.g. the development of new services or the generation of statistical data).

What legitimate interest does Flitsmeister have?

For the processing of personal data that does go beyond what is strictly necessary for the provision of our services, which is not based on a statutory duty, nor on your consent, Flitsmeister relies on what is called a "legitimate interest". That legitimate interest lies in everything that is necessary for the normal management and continuity of our business operations, in our interest to ensure the security and reliability of our products and services, as well as in our interest to be able to improve our products and services and develop new ones. Of course, in doing so, we take your privacy into account (as explained in this document). If you feel that we are violating your privacy, you are free to file a complaint (see below in this privacy statement).

Additional services

Additional services may be offered by Flitsmeister and by third parties.

Users with an account may be able to buy additional services from Flitsmeister. These services involve additional processing of personal data. We have already explained this in the section on purposes above. 

The exact data that will be processed depends on the additional services and the nature of these services. For example: giving personalised route information requires less data to be processed than drawing up a profile of your driving behaviour. As long as you do not use the additional services, we will not process your data for those purposes. And once you stop using an additional service, we will also stop processing your data for those purposes.

For additional services from third parties, you enter into a contract with that third party or you provide your prior consent to Flitsmeister to share your data with this third party, such as road authorities, being Rijkswaterstaat in The Netherlands or Agentschap Wegen en Verkeer in Flanders, Belgium. The terms and conditions and the privacy statement of that third party will apply. We will inform you about this before you purchase the service or before you give your consent to share your data with that third party. We recommend that you thoroughly read the privacy statement and terms of use of that third party before entering into a contract or before giving your consent.

If you buy additional services from third parties, Flitsmeister will only forward the information you have chosen to the third party in question. Flitsmeister only saves this information if you give us consent to do so. When asking for consent, we will which data is involved and the purpose for which we or the third party want to process that data.

Disclosure of data to third parties

The starting point is that we will never provide your data to third parties, unless you give your consent for the provision or we are legally obliged to do so.

Part of certain additional services may be that your data is shared with third parties. If that is the case, we will clearly inform you in advance. We will indicate what the privacy policy of the receiving party is. You can then decide for yourself whether or not you want to use the additional service (and therefore want to have your personal data passed on to that third party or not). In addition to commercial parties, third parties can also be road authorities, such as Rijkswaterstaat (NL) or the Agency for Roads and Traffic (Agentschap Wegen en Verkeer) in Flanders, as further described below.

Furthermore, we use a third party delivery service for any orders you place with us. This means that we will transfer your address details to that third party when you place an order.

Your data will not be disclosed to other third parties, unless we are obliged to do so by law. The only data that we disclose to other third parties in other cases is data at the aggregated or group level, so it is no longer traceable to an individual telephone or person. An example might be disclosing traffic information or statistical information about the amount of traffic on certain roads.

Cooperation with third parties

Flitsmeister cooperates in some countries with third parties, such as local or regional road authorities (a.o. Rijkswaterstaat (The Netherlands) or Agentschap Wegen en Verkeer (Flanders – Belgium)). In the case of a road authority, it receives specific information about traffic so that it can better do its job (e.g. optimize traffic flows, better adjust traffic lights, monitoring of driving behaviour, warning of approaching emergency services, etc.). You can help by sharing data.   

We only transfer this data if you give us permission to do so. The transfer is limited to data that cannot be traced back to a user, such as location data that is only linked to a unique session number (for information about the safeguards, see chapter ‘Location data’). Thus, we do not provide account or payment information. Because we cannot completely rule out the possibility that the data for the road authority may be traceable to a user, we ask your permission (on behalf of that road authority). In this way you keep maximum control over your data. Only if you fill in personal data yourself on any questionnaires from a road authority that you are offered via the app, your personal data will be passed on to such road authority. But of course you decide for yourself whether you want to participate or not.

Fleet Platform

Fleet Platform is an additional service that also shares data to third parties. Because Fleet Platform is slightly different from standard additional services, we hereby explain the service.

Fleet Platform has been developed for companies that use drivers, such as truck drivers, delivery drivers, and employees. The companies can be the driver's employer as well as other companies (such as the client of the drive).

The company can share a code with the driver via the Fleet Platform. By accepting the code, a link is made with the company's system and the company can track where the driver is driving.

The driver keeps control over his personal data. Only after the driver gives consent by accepting the code, data is shared with the company. The driver can then revoke his consent at any time.

The driver shares a limited set of data with the company via Fleet Platform. It only concerns the driver's name, location data, vehicle data and arrival times. With the exception of the name, no account information of the driver is shared with the company.

Both the company and the driver can request a 24-hour real-time view and an report of the last two months. The company can also set certain actions to be initiated when a driver approaches a Point of Interest set by the company, such as traffic lights or an intersection. Using these setting priority to the driver or automatic reporting of the presence of the relevant driver can be given. The location and vehicle data are sent with the signal.

For specific drives, a scan of the driver's ID may also be requested. The driver makes a scan (photo) of his ID himself. The driver's name, place of birth and date of birth are read and saved from the scan. The scan is temporarily stored locally on the phone while the data is being read. Other data than the data mentioned above, will be deleted immediately after the scan. Flitsmeister does not have access to the temporary storage of the scan. After the driver's consent, the name, place of birth and date of birth will only be shared with the company as part of the specific drive.

Finally, no departure buffer is applied (see chapter below) when a driver starts a journey.

Trip History

As is the case with Fleet Platform, Trip History works slightly differently. The trips you make are tracked and recorded. You can then view an automatically generated overview of your trips.

When you use the app, some of your details are recorded and further used, specifically vehicle data and trip data. Vehicle data is data such as registration number, the make of the car and mileage when manually entered into the app. Trip data includes start and end timestamps, speed and number of kilometres driven. The purpose of recording trip data is to give you an overview of your trips with their distances and destinations. The entire trip, from the point of departure to the destination, is recorded. This means that, in contrast with the normal use of the Flitsmeister app, no 'departure buffer' is applied that removes the location data of the departure and arrival points.

Using and storing location details

Location details will be processed and stored when you use the Flitsmeister app, subject to your prior consent. The route travelled, date/time and speed will then be recorded for every trip. 

This is done anonymously as explained below. 

By storing the data about your individual trips separately, we can provide you with interesting statistical data about your driving behaviour. This storage method is also necessary for us to be able to verify any information communicated to us, e.g. the presence of speed cameras. Storing the data in this manner is also necessary for us in order to generate statistical and other information (such as traffic information) described above.

The data we collect is anonymized. The main measures we have taken for this are:

  • ample departure buffer: we will not begin measuring until you have driven at least 500 metres. Furthermore, the starting points of our measurements differ from trip to trip. You will therefore become just one of the many other Flitsmeister users driving in your area. This means that we will not be able to use location details to trace exactly where you have come from.

  • unique session number: every trip is given its own unique number, which is different for every trip. These numbers are not interrelated in any way. We do not know who has which number. 

  • limited storage: we delete this anonymous data after six months. 

If you have an account, you can choose to opt-in, in order to link data for trips to the account in question. As soon as you do so, your data will no longer be anonymous. Statistics such as time travelled and top speed are automatically linked to the account. The user can reset them at any time.

When you use Trip History, your entire trip is recorded. In that case, your location data is stored in a separate database.

ETA sharing

ETA means sharing your Estimated Time of Arrival. If you have enabled ETA sharing, real-time location data will be sent to Flitsmeister during your trip. Whenever Flitsmeister receives new location data, the old location data is deleted. This means that no history of your location data is maintained. The most recent location will be held in the system for another 8 hours. This data is not linked to your identity

Profile score

Flitsmeister evaluates reports that users make through the app about, for example, a speed camera or traffic jam. Flitsmeister does this by using a calculation model. With the help of the calculation model useful reports are displayed in the app and incorrect reports are removed. In this way, Flitsmeister can ensure the quality of the app.   

When a user makes several usable reports, the user's profile score goes up. The same applies the other way around. If a user is found to make incorrect reports, his profile score goes down. The profile score is based on the accuracy of reports made in the last three months. Users have no insight into each other's profile score. It is only visible to Flitsmeister and it is not shared with third parties. If you do not want Flitsmeister to keep a profile score of you, you can object to this. You can read how to exercise your right to object later in this statement.

Data security measures

Flitsmeister takes appropriate technical and organisational measures to protect your personal data against loss or any form of unlawful processing. 

When you use Trip History, personal data is not automatically deleted after six months. Your data is stored for as long as you use Trip History in order to avoid the loss of your trip data. When you cancel your Trip History subscription, your data will be deleted two months after the cancellation date. In any event, Flitsmeister will not keep personal data for longer than is necessary.

Storage period of the data

Flitsmeister does not store personal data for longer than is necessary. Personal data is stored for a maximum period of 6 months after the last use. For the retention period of third parties, you should consult their privacy statement.

Statistical information using third party services

Google Analytics is a service offered by Google (www.google.com). Google processes the data that Flitsmeister collects by means of Analytics. For more information on how Google handles that personal data, please refer to Google's general privacy policy, which you can read here: http://www.google.com/privacy.html. Flitsmeister has set up Google Analytics in accordance with the Instructions on setting Google Analytics in a privacy-friendly manner (“Handleiding privacyvriendelijk instellen van Google Analytics”, version of August 2018) issued by the Dutch Data Protection Authority. 

Insider

Insider is a marketing platform. Insider processes the data that Flitsmeister collects. For more information on how Insider handles that personal data, please refer to Insider's privacy policy, which you can read here: https://useinsider.com/privacy-policy. 

Your rights

Withdrawing your consent

The app enables you to deactivate the option of logging location details. If you deactivate this option, you also revoke your consent for us to log these details. Deactivating the option does not affect the data we stored before deactivation; deactivation only applies to future location details. Furthermore, deactivating the option only means that we will no longer process any location details about you. The processing of other data, e.g. statistics about the use of the app, will continue.

Right of access

You have a statutory right to know which of your personal data is processed by Flitsmeister. It is very important for us to be certain that we are passing on this data to the right person. That is why we will be creating an option enabling you to view this data through your account. We will inform everyone involved as soon as this option is available.

Users who have no account and anyone who cannot wait for the feature described above can call in at our head office, bringing their phones. This is the only way in which we can make sure that we are providing the details to the right person. 

Right of rectification and erasure

After receiving the summary of your data, you can ask us to rectify, complement, remove or hide it if you think this data is not correct or if its being processed is not relevant or is a violation of any statutory provisions. To do this, you can contact us using the address details shown above. We will then decide about your request within four weeks and inform you accordingly.

Right to data portability

You have the right to receive in a digital file format location data and all other data that we have processed on the basis of your consent. You can contact us via the address below. Keep in mind that by default - if you do not have an account - your location data will be anonymized fairly quickly by us (see explanation in this privacy statement). It is therefore possible that we may not be able to provide you with a lot of data. 

Right to object

For all processing that is not based on your consent and that goes beyond what is necessary for compliance with legal obligations or the execution of the agreement, you may submit an objection using the information below. After receiving your objection we will suspend any further processing of your data. However, if we are of the opinion that we cannot stop the processing, we will inform you about this with a clear justification.

Data protection officer

Flitsmeister has appointed a Data Protection Officer (DPO). The DPO supervises compliance with privacy legislation and advises Flitsmeister on privacy legislation.

The DPO is independent and enjoys legal employment protection. The DPO reports directly to the top manager of Flitsmeister.

The DPO is also the contact person for all questions concerning privacy, both for you as the data subject and for the regulator.

Data Protection Authority

Compliance with privacy legislation is supervised by an independent national Data protection Authority (DPA). You have the right to lodge a complaint with the DPA. Fleet Platform

Fleet Platform is an additional service that also shares data to third parties. Because Fleet Platform is slightly different from standard additional services, we hereby explain the service.

Fleet Platform has been developed for companies that use drivers, such as truck drivers, delivery drivers, and employees. The companies can be the driver's employer as well as other companies (such as the client of the drive).

The company can share a code with the driver via the Fleet Platform. By accepting the code, a link is made with the company's system and the company can track where the driver is driving.

The driver keeps control over his personal data. Only after the driver gives consent by accepting the code, data is shared with the company. The driver can then revoke his consent at any time.

The driver shares a limited set of data with the company via Fleet Platform. It only concerns the driver's name, location data, vehicle data and arrival times. With the exception of the name, no account information of the driver is shared with the company.

Both the company and the driver can request a 24-hour real-time view and an report of the last two months. The company can also set certain actions to be initiated when a driver approaches a Point of Interest set by the company, such as traffic lights or an intersection. Using these setting priority to the driver or automatic reporting of the presence of the relevant driver can be given. The location and vehicle data are sent with the signal.

For specific drives, a scan of the driver's ID may also be requested. The driver makes a scan (photo) of his ID himself. The driver's name, place of birth and date of birth are read and saved from the scan. The scan is temporarily stored locally on the phone while the data is being read. Other data than the data mentioned above, will be deleted immediately after the scan. Flitsmeister does not have access to the temporary storage of the scan. After the driver's consent, the name, place of birth and date of birth will only be shared with the company as part of the specific drive.

Finally, no departure buffer is applied (see chapter below) when a driver starts a journey.

Trip History

As is the case with Fleet Platform, Trip History works slightly differently. The trips you make are tracked and recorded. You can then view an automatically generated overview of your trips.

When you use the app, some of your details are recorded and further used, specifically vehicle data and trip data. Vehicle data is data such as registration number, the make of the car and mileage when manually entered into the app. Trip data includes start and end timestamps, speed and number of kilometres driven. The purpose of recording trip data is to give you an overview of your trips with their distances and destinations. The entire trip, from the point of departure to the destination, is recorded. This means that, in contrast with the normal use of the Flitsmeister app, no 'departure buffer' is applied that removes the location data of the departure and arrival points.

Using and storing location details

Location details will be processed and stored when you use the Flitsmeister app, subject to your prior consent. The route travelled, date/time and speed will then be recorded for every trip. 

This is done anonymously as explained below. 

By storing the data about your individual trips separately, we can provide you with interesting statistical data about your driving behaviour. This storage method is also necessary for us to be able to verify any information communicated to us, e.g. the presence of speed cameras. Storing the data in this manner is also necessary for us in order to generate statistical and other information (such as traffic information) described above.

The data we collect is anonymized. The main measures we have taken for this are:

  • ample departure buffer: we will not begin measuring until you have driven at least 500 metres. Furthermore, the starting points of our measurements differ from trip to trip. You will therefore become just one of the many other Flitsmeister users driving in your area. This means that we will not be able to use location details to trace exactly where you have come from.

  • unique session number: every trip is given its own unique number, which is different for every trip. These numbers are not interrelated in any way. We do not know who has which number. 

  • limited storage: we delete this anonymous data after six months. 

If you have an account, you can choose to opt-in, in order to link data for trips to the account in question. As soon as you do so, your data will no longer be anonymous. Statistics such as time travelled and top speed are automatically linked to the account. The user can reset them at any time.

When you use Trip History, your entire trip is recorded. In that case, your location data is stored in a separate database.

ETA sharing

ETA means sharing your Estimated Time of Arrival. If you have enabled ETA sharing, real-time location data will be sent to Flitsmeister during your trip. Whenever Flitsmeister receives new location data, the old location data is deleted. This means that no history of your location data is maintained. The most recent location will be held in the system for another 8 hours. This data is not linked to your identity

Profile score

Flitsmeister evaluates reports that users make through the app about, for example, a speed camera or traffic jam. Flitsmeister does this by using a calculation model. With the help of the calculation model useful reports are displayed in the app and incorrect reports are removed. In this way, Flitsmeister can ensure the quality of the app.   

When a user makes several usable reports, the user's profile score goes up. The same applies the other way around. If a user is found to make incorrect reports, his profile score goes down. The profile score is based on the accuracy of reports made in the last three months. Users have no insight into each other's profile score. It is only visible to Flitsmeister and it is not shared with third parties. If you do not want Flitsmeister to keep a profile score of you, you can object to this. You can read how to exercise your right to object later in this statement.

Data security measures

Flitsmeister takes appropriate technical and organisational measures to protect your personal data against loss or any form of unlawful processing. 

When you use Trip History, personal data is not automatically deleted after six months. Your data is stored for as long as you use Trip History in order to avoid the loss of your trip data. When you cancel your Trip History subscription, your data will be deleted two months after the cancellation date. In any event, Flitsmeister will not keep personal data for longer than is necessary.

Storage period of the data

Flitsmeister does not store personal data for longer than is necessary. Personal data is stored for a maximum period of 6 months after the last use. For the retention period of third parties, you should consult their privacy statement.

Statistical information using third party services

Google Analytics is a service offered by Google (www.google.com). Google processes the data that Flitsmeister collects by means of Analytics. For more information on how Google handles that personal data, please refer to Google's general privacy policy, which you can read here: http://www.google.com/privacy.html. Flitsmeister has set up Google Analytics in accordance with the Instructions on setting Google Analytics in a privacy-friendly manner (“Handleiding privacyvriendelijk instellen van Google Analytics”, version of August 2018) issued by the Dutch Data Protection Authority. 

Insider

Insider is a marketing platform. Insider processes the data that Flitsmeister collects. For more information on how Insider handles that personal data, please refer to Insider's privacy policy, which you can read here: https://useinsider.com/privacy-policy. 

Your rights

Withdrawing your consent

The app enables you to deactivate the option of logging location details. If you deactivate this option, you also revoke your consent for us to log these details. Deactivating the option does not affect the data we stored before deactivation; deactivation only applies to future location details. Furthermore, deactivating the option only means that we will no longer process any location details about you. The processing of other data, e.g. statistics about the use of the app, will continue.

Right of access

You have a statutory right to know which of your personal data is processed by Flitsmeister. It is very important for us to be certain that we are passing on this data to the right person. That is why we will be creating an option enabling you to view this data through your account. We will inform everyone involved as soon as this option is available.

Users who have no account and anyone who cannot wait for the feature described above can call in at our head office, bringing their phones. This is the only way in which we can make sure that we are providing the details to the right person. 

Right of rectification and erasure

After receiving the summary of your data, you can ask us to rectify, complement, remove or hide it if you think this data is not correct or if its being processed is not relevant or is a violation of any statutory provisions. To do this, you can contact us using the address details shown above. We will then decide about your request within four weeks and inform you accordingly.

Right to data portability

You have the right to receive in a digital file format location data and all other data that we have processed on the basis of your consent. You can contact us via the address below. Keep in mind that by default - if you do not have an account - your location data will be anonymized fairly quickly by us (see explanation in this privacy statement). It is therefore possible that we may not be able to provide you with a lot of data. 

Right to object

For all processing that is not based on your consent and that goes beyond what is necessary for compliance with legal obligations or the execution of the agreement, you may submit an objection using the information below. After receiving your objection we will suspend any further processing of your data. However, if we are of the opinion that we cannot stop the processing, we will inform you about this with a clear justification.

Data protection officer

Flitsmeister has appointed a Data Protection Officer (DPO). The DPO supervises compliance with privacy legislation and advises Flitsmeister on privacy legislation.

The DPO is independent and enjoys legal employment protection. The DPO reports directly to the top manager of Flitsmeister.

The DPO is also the contact person for all questions concerning privacy, both for you as the data subject and for the regulator.

Data Protection Authority

Compliance with privacy legislation is supervised by an independent national Data protection Authority (DPA). You have the right to lodge a complaint with the DPA. You can also contact the DPA regarding questions about the privacy legislation. More information about some of the national DPA’s can be found in the overview below. In addition, you can always contact the 'lead DPA’. In the case of Flitsmeister, it is the Dutch DPA.
